1. Definition.

The Cangkat Cendana Group Sdn. Bhd. website (hereinafter referred to as "Cangkat Cendana website") is an online service operated by Cangkat Cendana Group Sdn. Bhd. (hereinafter referred to as "Cangkat Cendana"). The site includes information services and content provided by Cangkat Cendana, affiliates of Cangkat Cendana, and other third parties. "User" means each person who establishes or accesses a connection (hereinafter referred to as "Account") for access to and use of the Cangkat Cendana website.

2. General.

(A) The Terms of Use define the terms and conditions that apply to the use of the Cangkat Cendana website by the User. By accessing and using the Cangkat Cendana website, the User agrees to comply with all of the terms and conditions hereof. The right to use the Cangkat Cendana website is personal to the User and is not transferable to any other person or entity. The User is responsible for all use of the User's Account (under any screen name or password) and for ensuring that all use of the User's Account complies fully with the provisions of the Terms of Use. The User shall be responsible for protecting the confidentiality of the User's password(s), if any.

(B) Cangkat Cendana shall have the right, at any time, to change or discontinue any aspect or feature of the Cangkat Cendana website, including, but not limited to, content, hours of availability, and equipment needed for access or use, without notice.

3. Amendments of Terms of Use.

Cangkat Cendana shall have the right, at any time, to delete, change, update or modify the terms and conditions applicable to the User's use of the Cangkat Cendana website or any part thereof or to impose new conditions for the use of the Cangkat Cendana website. Such changes, updates, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means of, including, but not limited to, posting on the Cangkat Cendana website, by electronic mail, or by any other means the User obtains notice thereof. Any use of the Cangkat Cendana website by the User after the issuance of such notice shall be deemed to constitute acceptance by the User of such deletions, changes, updates, modifications or additions.

 

4. Equipment.

The User shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed to access and use the Cangkat Cendana website and all charges related thereto.

5. User Conduct.

(A) The User shall use the Cangkat Cendana website for lawful purposes only. The User shall not post, publish, upload, distribute, reproduce, modify, or transmit through the Cangkat Cendana website any material which violates or infringes upon the rights of others in any way, which is unlawful, threatening, abusive, defamatory, an invasion of privacy, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law, or which, without Cangkat Cendana's prior express written approval, contains advertising or any solicitation with respect to products or services.

(B) The Cangkat Cendana website contains material subject to the protection of copyright, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the contents of the Cangkat Cendana website are subject to copyright as a collective work under the applicable copyright laws. The User may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part.

6. Third-Party Content.

Cangkat Cendana is not responsible for the availability or content of any third-party websites or material accessed through the Cangkat Cendana website. Cangkat Cendana does not exercise any control or supervision of the content of these linked websites.

 

7. Indemnification.

The User agrees to defend, indemnify and hold harmless Cangkat Cendana from and against all liabilities, claims, damages and expenses, including legal fees, arising out of the User's use of the Cangkat Cendana website or the User's violation or alleged violation of the terms, conditions or representations herein.

8. Termination.

Cangkat Cendana has the right to terminate or restrict the User's access to the Cangkat Cendana website, without notice, for any reason whatsoever and also reserves the right to block access from a particular Internet address to the website.

9. Severability.

Suppose any provision of this Agreement is found by a court or other binding authority to be invalid. In that case, the remaining provisions contained in this Agreement shall continue in full force and effect.

10. Limitation of Liability.

Cangkat Cendana shall not be liable for any damages or losses suffered by the User, including indirect or consequential loss, loss of profits, economic loss or loss of goodwill, arising in any way from the User's use of the Cangkat Cendana website or from any information or omissions contained in the Cangkat Cendana website.

11. Emblem and Name.

The use of the Cangkat Cendana name and emblem is strictly prohibited without the express written consent of Cangkat Cendana.

 

12. Monitoring.

Cangkat Cendana has the right, but not the obligation, to monitor the content of the Cangkat Cendana website to determine compliance with the Terms of Use and any operating rules established by Cangkat Cendana.

13. Privacy.

The User acknowledges that all discussion for ratings, comments, bulletin board service, chat rooms and/or other message or communication facilities are public and not private communications and that, therefore, others may read the User's communications without the User's knowledge. Cangkat Cendana does not control or endorse the content, messages or information found in any community, and, therefore, Cangkat Cendana specifically disclaims any liability concerning the communities and any actions resulting from the User's participation in any community, including any objectionable content.

14. Miscellaneous.

This Agreement and any rules for the Cangkat Cendana website established by Cangkat Cendana constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all previous written or oral agreements between the parties with respect to such subject matter.
